Terms and Conditions for Candidates of the Jober Service

1. General Provisions

  1. The online service operated under the domain jober.uk (hereinafter the "Service") is owned and operated by Jober Ltd, with its registered address at 406 Teyleur, Manchester, M50 3AQ, United Kingdom, registered under company number 15328589 (hereinafter the "Owner").
  2. These Terms and Conditions govern the use of the Service by candidates, defined as natural persons seeking employment who use the platform to create profiles, browse job vacancies and submit job applications (hereinafter referred to as "Users" or "Candidates").
  3. By creating an account or submitting an application through the Service, the User confirms that they have read, understood and agreed to be bound by these Terms and Conditions.
  4. The Service shall be used in accordance with all applicable laws and regulations, including the laws of England and Wales and applicable international and European legislation.
  5. Users are prohibited from publishing or transmitting any content that is unlawful, misleading, defamatory, offensive, obscene, pornographic or that infringes intellectual property rights or other rights of third parties.
  6. The Owner shall not be liable for any loss or damage arising from technical errors, system failures, interruptions or temporary unavailability of the Service. No compensation shall be payable to the User in such circumstances.

2. Candidate Account

  1. Access to candidate-specific features of the Service requires the creation of a personal account using a valid and current email address.
  2. Account activation is subject to verification of the email address provided by the User.
  3. The User is solely responsible for maintaining the confidentiality of login credentials and for all activities conducted through their account.
  4. The User undertakes to provide accurate, complete and up-to-date information. The provision of false or misleading information may result in suspension or permanent termination of the account.
  5. The Owner reserves the right to suspend or terminate a User account, without prior notice, in particular where the User:
    • breaches these Terms and Conditions;
    • provides false, misleading or incomplete information;
    • engages in fraudulent or unlawful activity;
    • uses the Service in a manner that causes or may cause harm to other Users or the Owner.

3. Personal Data and CV Information

  1. In the course of using the Service, the Owner processes personal data of Users, including but not limited to: name, email address, telephone number, location, curriculum vitae (CV), employment history and professional qualifications.
  2. Personal data are processed for the purposes of:
    • managing job applications;
    • matching Users with relevant job vacancies;
    • communicating with Users regarding their accounts and applications;
    • improving and developing the Service.
  3. When a User applies for a vacancy, their CV and application data are transmitted directly to the employer who posted the vacancy. From that point, the employer acts as an independent data controller.
  4. The Owner accepts no responsibility for how employers subsequently process, store or safeguard personal data. Users are encouraged to review the privacy policies of employers prior to applying.
  5. Personal data are retained for as long as the User maintains an active account. Users may request the deletion of their data in accordance with applicable data protection laws, including the UK GDPR.
  6. Further details regarding the processing of personal data are provided in the Privacy Policy of the Service.

4. Electronic Communications

  1. By creating an account, the User consents to receive essential electronic communications required for the operation of the Service, including communications relating to:
    • account verification and security;
    • application status updates;
    • messages from employers;
    • material changes to the Service or these Terms and Conditions.
  2. Such communications are necessary for the proper functioning of the account and cannot be opted out of while the account remains active.
  3. The User may optionally consent to receive job alerts and marketing communications and may withdraw such consent at any time via account settings or unsubscribe links.
  4. SMS communications may be subject to charges imposed by the User's mobile network operator.

5. Job Vacancies and Applications

  1. All job vacancies published via the Service are the sole responsibility of the employers who post them.
  2. The Owner does not warrant or guarantee the accuracy, completeness or validity of any job vacancy.
  3. If a User suspects that a vacancy is fraudulent or misleading, they should notify the Owner without undue delay.
  4. The Owner does not act as an intermediary in disputes between Candidates and employers, without prejudice to any legal obligations to cooperate with competent authorities.

6. Referral Programme

  1. Registered Candidates may participate in the Referral Programme where such functionality has been enabled by the relevant employer.
  2. Referral rewards, including payment conditions and amounts, are determined solely by employers.
  3. The Owner acts only as a technical facilitator and is not responsible for the payment of referral rewards.
  4. Any rewards received may be subject to tax. Users are solely responsible for complying with all applicable tax obligations.
  5. Fraudulent conduct, including self-referrals, false applications or system manipulation, will result in immediate disqualification from the Referral Programme and may lead to account termination.
  6. The Owner reserves the right to amend or terminate the Referral Programme at any time.

7. Intellectual Property and Security

  1. All content and materials forming part of the Service, including logos, designs, text, layouts and software, are protected by intellectual property laws.
  2. Any unauthorised access to the Service's systems, databases or source code constitutes a legal offence and may result in civil and criminal proceedings.

8. Amendments to the Terms

  1. The Owner reserves the right to amend these Terms and Conditions at any time.
  2. Continued use of the Service following the effective date of any amendments constitutes acceptance of the revised Terms and Conditions.
